Agreement for Snowkiting Training Services
This Agreement is made and entered into on this ___ day of _______, 20, by and between:
Snowkiting in Alberta (hereinafter referred to as the “Instructor”), and
[Client’s Full Name] (hereinafter referred to as the “Client”).
1. Scope of Services The Instructor agrees to provide the Client with snowkiting training services, which include practical and theoretical lessons over a total duration of 10 hours. The training will focus on developing the Client’s skills in snowkiting, including safety procedures, equipment handling, riding techniques, and understanding weather conditions suitable for snowkiting.
2. Training Schedule The training sessions will be conducted at mutually agreed-upon times and locations suitable for snowkiting. Any changes to the schedule must be communicated and agreed upon by both parties in advance.
In the event of adverse weather conditions, the Instructor reserves the right to reschedule sessions to ensure the safety of the Client.
3. Payment Terms The Client agrees to pay a total fee of $1,200 CAD for the 10-hour training program. Payment is due as follows:
- 50% ($600 CAD) upon signing this Agreement to secure the training schedule.
- 50% ($600 CAD) before the first training session.
Payments can be made via [insert payment methods, e.g., bank transfer, PayPal, cash].
Late payments may result in a delay or cancellation of scheduled sessions until payment is received.
4. Cancellation Policy
- The Client may cancel or reschedule a session by providing at least 48 hours’ notice.
- Cancellations with less than 48 hours’ notice or no-shows will result in the forfeiture of the payment for the missed session.
- In the event of cancellation by the Instructor due to unforeseen circumstances, the session will be rescheduled at no additional cost.
If the Client decides to terminate the training program early, any unused portion of the fee will not be refunded unless otherwise agreed upon in writing by both parties.
5. Liability Waiver The Client acknowledges and agrees that snowkiting is an activity that involves inherent risks, including but not limited to falls, collisions, adverse weather conditions, and equipment malfunctions. By signing this Agreement, the Client assumes all responsibility for any injuries or damages that may occur during the training sessions and agrees to hold the Instructor harmless from any claims or liabilities.
The Client is advised to obtain personal accident insurance to cover any potential injuries during the training sessions.
6. Equipment The Instructor will provide the necessary snowkiting equipment for the training. The Client agrees to handle the equipment with care and will be responsible for any damage caused due to negligence or misuse.
If the Client wishes to use their own equipment, the Instructor will inspect it to ensure it is safe and suitable for training. The Instructor reserves the right to decline the use of equipment deemed unsafe.
7. Code of Conduct The Client agrees to follow all instructions provided by the Instructor to ensure their safety and the safety of others. Any reckless or dangerous behavior may result in the immediate termination of the training session without a refund.
8. Governing Law This Agreement shall be governed by the laws of the Province of Alberta, Canada.
9. Entire Agreement This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or agreements regarding the training services. Any amendments to this Agreement must be made in writing and signed by both parties.
